1. PAYMENT TERMS
Payment must be made in full prior to the release of any goods. Any payments not honoured (including but not limited to dishonoured cheques or reversed credit card transactions) may be charged interest at a rate of 18%p.a. All costs incurred by the supplier in collection of overdue amounts, including but not limited to all legal costs, court fees and commission or fees payable to a debt collection agency, shall be paid by the debtor. All prices quoted are in New Zealand currency unless otherwise stated.
2. RISK
All goods supplied by TIGHTLINES MEDIA LTD will be at the customer's risk immediately on delivery.
3. OWNERSHIP
3.1 Legal ownership of any goods supplied by TIGHTLINES MEDIA LTD to the customer will remain the property of TIGHTLINES MEDIA LTD until payment is made in full for the goods, and any other amounts owing by the customer to TIGHTLINES MEDIA LTD.
3.2
TIGHTLINES MEDIA LTD reserves the right to enter the customer's premises during normal working hours with reasonable notice and repossess any goods for which the right of sale has been revoked upon the occurrence of any of the events described in section 3.
4. RETURNS
a) Specially procured parts are NON-RETURNABLE & NON-REFUNDABLE
b) Returns will only be accepted at the discretion of TIGHTLINES MEDIA LTD but in accordance with the Consumers Guarantee Act 1993.
c) Returns must be in new condition with packing intact and accompanied by the invoice.
d) TIGHTLINES MEDIA LTD charges a 20% restocking fee on returned goods.
e) Returns must be no older than 14 days past the date of invoicing.
f) DVD's will be inspected before supply and are non-returnable & non-refundable other than in the event or being incorrectly supplied. The customer is required to advise TIGHTLINES MEDIA LTD of any issues arising from the supply of DVD's on the day of delivery.
5. DELIVERY
Delivery fees are non-refundable.
Every order incurs a delivery fee. Where multiple items are added to your cart to fulfil an order, 1 delivery fee will apply.
Orders may take up to 1-2 business days to process before being shipped. Courier Post will deliver orders in 2-3 business days after shipment. Rural addresses can add 1-3 days to the delivery time.
Courier Post will deliver during regular business hours, Monday to Friday, excluding public holidays.
6. REFUNDS
Refunds will be issued at the discretion of Tightlines Media Ltd. (see 4. Returns)
Refunds will normally be processed within seven (7) business days.
7. CANCELLATION
Cancellations of orders are not accepted.
8. CONSUMER GUARANTEES ACT 1993 EXCLUDED
No condition, warranty or promise, expressed or implied, other than those provided by the Consumer Guarantees Act 1993 applies to this agreement.
Except as provided in the Consumer Guarantees Act 1993, TIGHTLINES MEDIA LTD shall not be liable for any loss of any kind whatsoever suffered by the customer as a result of any breach of any of TIGHTLINES MEDIA LTD's obligation under this agreement including any cancellation of this agreement or any negligence on the part of TIGHTLINES MEDIA LTD, its servants, agents of contractors nor shall TIGHTLINES MEDIA LTD be liable for any loss, damage or injury caused to the customer's servants, agents, contractors, customers, visitors, tenants, trespassers or other such persons. The customer will identify TIGHTLINES MEDIA LTD against any claim by any such persons.
9. WARRANTY
TIGHTLINES MEDIA LTD products (excluding DVD's) carry the manufactures warranty. DVD's are supplied in accordance with clause 4f of this document.
10. LIABILITY
Notwithstanding anything else in this agreement, the liability of TIGHTLINES MEDIA LTD arising from breach of any TIGHTLINES MEDIA LTD's obligations under this agreement, from any cancellation on this agreement or from any negligence on TIGHTLINES MEDIA LTD's parts, its servant, agents or contractors (but not for any liability under the Consumer Guarantees Act 1993) will be limited to damages which will not exceed the contract price.
11. ALTERATION
TIGHTLINES MEDIA LTD reserves the right to alter this agreement without giving notice at its sole discretion.
12. SECURITY
This website (www.thefishingshow.co.nz) uses SSL (Secure Socket Layer) for all shop pages and does not store credit card details.
All payments are handled by a secure, PCI compliant third party payment processor, whether through PayPal or Payment Express (DPS).
